Important Feature Film News

As you may know, the AWG Feature Film Committee has been at work to improve contract conditions for our members writing feature films.  This year, we are preparing to start negotiations with producers for a Feature Film Agreement covering fees, contingent payments, rights and all the issues that surround Feature Film projects.  

The Feature Film Agreement is very important as it will set the industry standard.  But in the Australian market, most of our members approach their projects by writing a script first, then seeking out a producer to move the project into production.  To protect rights and intellectual property, the writer should have an Option & Assignment Deed in place with the producer before further development begins. 

To assist members, the AWG has issued a new model Option & Assignment Deed (found in Members' Area under Industrial -> Contracts) for features with clear definitions and timelines, values indicated for fees and contingent payments and clear and up-to-date rights and reserved rights.  It is now available on line in the members' area or from the AWG Industrial Team.

Remember, protect your rights when optioning your work:

• Register your script with the AWG before releasing it to any interested parties.
• Keep a record of anyone who reads your script.  
• Have the Option & Assignment Deed signed before releasing your script for financing and development.
• Use the AWG Option & Assignment Deed as is – check any producer modifications with the AWG.
• Make sure both the Option & Assignment Deed are signed by the producer – the Assignment Deed only becomes effective when the option is exercised – to protect your earnings and rights on the project.
